Law360 Covers Customs Fraud Whistleblower Settlement in Case Brought by Newman & Shapiro
On November 10, 2022, Law360 published an article, “Calif. Importer Pays $3.25M To End Customs Fraud Case,” on a recent settlement in a customs fraud False Claims Act qui tam case brought by Newman & Shapiro. In the case, whistleblower Chris Chan, a Hong Kong resident, alleged that a California-based importer was evading tariffs on Chinese merchandise by understating the prices it paid for the goods. According to the article, Newman & Shapiro attorney Gregg Shapiro said that “a very small percentage of whistleblower cases are brought by people living overseas,” and that “[o]verseas whistleblowers have the potential to expose customs fraud in the United States.”
Taxpayers Against Fraud Bestows Gregg Shapiro with 2022 Public-Private Partnership Award
At its annual conference on October 27, 2022, Taxpayers Against Fraud (TAF), the national association of whistleblower attorneys, bestowed its 2022 Public-Private Partnership Award on Gregg Shapiro and other members of the government team that obtained a $233.7 million settlement with Mallinckrodt, a large pharmaceutical firm. When he was an Assistant United States Attorney and Chief of the Affirmative Civil Enforcement Unit in the United States Attorney’s Office for the District of Massachusetts, Shapiro led the office’s False Claims Act investigation of Mallinckrodt, which had raised the price of the drug Acthar Gel from $50 to $28,000 per vial, but had failed to pay state Medicaid programs the substantial rebates it owed as a result of that price increase. Gregg Shapiro Quoted in Law360: Biogen Whistleblower’s $250M Award ‘Extraordinary’ For FCA
In an article on September 28, 2022, Law360 quoted Newman & Shapiro attorney Gregg Shapiro on the recent $900 million False Claims Act qui tam settlement with Biogen and DOJ’s decision to award the whistleblower $250 million from the federal settlement amount. Shapiro noted that the award “obviously provides an extraordinary incentive to other potential whistleblowers, and whistleblower attorneys, to bring meritorious cases and, if necessary, to litigate them through trial, or in this case, to the brink of trial.”
Akorn to Pay $7.9 Million to Resolve Medicare Fraud Claims
On September 15, 2022, the Department of Justice announced a $7.9 million settlement with pharmaceutical company Akorn to resolve False Claims Act allegations in a qui tam case that Newman & Shapiro filed on behalf of its client, Albermarle, LLC.

Gregg Shapiro, who was heading an industry-wide probe of drugmakers’ financial support of patient assistance charities before leaving the U.S. Attorney’s Office in Massachusetts, is joining with Jeffrey Newman to form Newman & Shapiro.
