DOJ to encourage corporate confessions of fraud in return for reduced criminal penalties and, in some cases non-prosecution

Federal prosecutors have established a new policy, effective immediately for companies that self-report fraud and misconduct in return for which they will receive more lenient treatment. The benefits may include reduced criminal financial penalties and in some cases, none. In certain cases, the prosecutors may decline to prosecute. In other cases, the prosecution may still seek guilty pleas where the current executive management commits the wrongdoing or poses a threat to national security or public health.
